Prepare a written answer to the following question. Your answer (1500 words maximum) Omar is a bouncer at local nightclub. One night he notices that Jimmy, a regular at the club, is extremely drunk and making a nuisance of himself. Omar asks Jimmy to leave. Jimmy walks towards the club’s exit but then begins singing loudly at the top of his voice. Omar is frustrated and pushes Jimmy down a set of steps leading to the exit. Jimmy falls down the steps and through the glass door at the bottom. He suffers a deep cut to his arm and a fractured leg. An ambulance is called but, due to an ambulance strike, it is delayed by an hour. The delay means that by the time Jimmy gets to the hospital, he has lost a lot of blood. He is offered a blood transfusion, which he refuses due to an irrational and unfounded fear that the blood might be infected. Jimmy is then treated with antibiotics, to which he is allergic. Carlos, the doctor on duty, realises that Jimmy is suffering an allergic reaction and stops the antibiotics. The next day, Jimmy is seen by a different doctor, Gabrielle, who fails to read the medical notes properly and recommences the course of antibiotics. Jimmy again suffers an allergic reaction. The combination of the second allergic reaction and the blood loss weaken Jimmy significantly, meaning that it will take much longer for his leg to heal. Jimmy is confined to his hospital bed in the meantime. A week later, Jimmy dies of a pulmonary embolism (blood clot) due to his inactivity. Discuss the liability of Omar and Gabrielle for involuntary manslaughter.
